Terms & Conditions – Fly Claim
Last Updated: 20/07/2025Welcome to Fly Claim. These Terms of Service (hereinafter "TOS") govern the use of the website
www.fly-claim.com and the services offered by Fly Claim. By using our platform, you unconditionally agree to these terms.
1. Purpose of the Service
Fly Claim is a passenger flight compensation assistance service in accordance with Regulation (EC) No. 261/2004 and other applicable regulations.We act on behalf of passengers to claim compensation from airlines in the event of a flight that is:
– Delayed
– Cancelled
– Overbooked
– Downgraded to a lower class
– Causing a missed connection
2. Eligibility for the Service
By using Fly Claim, you declare that:
– You are of legal age and legally competent
– You were personally affected by a flight disruption
– The information provided is accurate and truthful
– You have not already submitted this claim to another intermediary or started parallel legal proceedings
3. Mandate and Authorization to Represent
By checking the box in the claim form, the User authorizes Fly Claim to act on their behalf regarding their compensation claim for delays, cancellations, denied boarding, or other air transport issues.
This mandate includes, without limitation:
- Collecting and processing necessary information for the claim
- Contacting the airline, its customer service, or representatives; drafting, sending, and following up on all correspondence
- Negotiating and receiving compensation offers; if necessary, forwarding the case to a legal partner or lawyer appointed by Fly Claim, at no additional cost to the User unless explicitly stated
The User acknowledges that this mandate is irrevocable for the duration of the claim process, unless expressly terminated in writing, and agrees to immediately inform Fly Claim of any communication received from the airline regarding the flight.
By confirming the claim, the User guarantees that all information provided is accurate and that they are legally authorized to grant this mandate.
4. Commission and Payment Terms
Fly Claim operates without upfront fees.
A fixed commission of 30% VAT included is applied only in case of success, based on the total amount paid by the airline.
In case of failure, no fees are charged.
Compensation is transferred via bank transfer after Fly Claim receives the funds.
5. Transmission of Bank Details
After the airline approves the compensation, Fly Claim will send a secure link to collect your bank details (IBAN).Your data is protected according to current security standards (see our Privacy Policy).
6. Timelines
Processing times vary depending on the airline and jurisdiction:
– From a few weeks to several months
– In case of legal proceedings, the timeline may be extended
Fly Claim commits to providing regular updates on your claim.
7. Responsibilities
Fly Claim does its utmost to defend your rights, but cannot guarantee a positive outcome in all cases.We are not responsible for:
– Decisions by airlines or courts
– Incorrect information provided by the client
– Delays caused by external factors (strikes, administrative closures, etc.)
8. Termination
You may terminate your mandate at any time, except if the procedure has already been initiated with the airline or in court.
In case of unjustified termination, Fly Claim reserves the right to claim already incurred costs, up to the amount of the agreed commission.

Fly Claim collects and processes your personal data in compliance with GDPR. See our Privacy Policy for more details.
10. Governing Law and Jurisdiction
These TOS are governed by French law. In case of dispute, the exclusive jurisdiction is granted to the courts of the Fly Claim headquarters, unless otherwise mandated by law.
11. Right of Withdrawal
Under Articles L221-18 et seq. of the French Consumer Code, you have 14 days from the conclusion of the contract (signing of the claim mandate) to exercise your right of withdrawal.
However, by validating the mandate and explicitly requesting Fly Claim to begin the service immediately, you acknowledge and agree that the processing of your claim starts before the end of the withdrawal period.
In this case, you expressly waive your right of withdrawal in accordance with Article L221-28 of the Consumer Code.
