What Fly Claim does
We act as your representative/mandatary for the purpose of submitting and managing your claim with the airline (and, where appropriate, with partners).
Eligibility
By using Fly Claim, you confirm you have the legal capacity to use the service and that you provide accurate, complete, and truthful information.
Mandate & authorization to represent you
By validating your claim and accepting the mandate (where applicable), you authorize Fly Claim to act on your behalf for the purpose of pursuing compensation (delay, cancellation, denied boarding, missed connection, etc.).
Success fee & payment terms
No upfront fees
You pay nothing upfront to submit and process your claim.
Success fee
A success fee is charged only if compensation is obtained. The exact rate and calculation method are stated on your pricing/terms pages and/or in your mandate confirmation.
Bank details
Once compensation is approved/confirmed, you may be asked to provide your bank details (e.g., IBAN) via a secure link. The information must match the claim beneficiary unless justified.
Timelines
Timelines vary depending on the airline and the complexity of the case, from a few weeks to several months. If legal escalation is required, the process can take longer. We aim to keep you informed of progress.
Liability
Fly Claim will use reasonable efforts to pursue your claim, but does not guarantee a successful outcome. We are not responsible for third-party decisions (airlines, authorities, courts), delays beyond our control, or losses resulting from inaccurate information provided by the user.
Termination
You may request termination of the mandate according to the applicable terms. Depending on the stage of the case (e.g., if substantial work has already been performed or escalation has begun), termination may have consequences as described in the mandate/terms.
Personal data
Fly Claim processes personal data in accordance with applicable data protection rules (including GDPR where relevant). Data may be shared with partners when strictly necessary to process your claim.
Governing law & jurisdiction
These T&C are governed by French law, unless mandatory rules provide otherwise. In case of dispute, jurisdiction is assigned to the competent courts under applicable law.
Right of withdrawal
If you are a consumer, you may have a statutory right of withdrawal (e.g., 14 days) depending on the applicable rules. If you request immediate performance of the service, you may lose the right of withdrawal once processing has begun, as permitted by law.
